John J. Malm & Associates Files Lawsuit Against Wendy’s For Foodborne Illness

CHICAGO, ILLINOIS — August 26, 2026 — John J. Malm & Associates announced today that the firm has filed a lawsuit on behalf of a client who alleges that they suffered a serious Campylobacter infection after consuming food purchased from a Wendy’s restaurant. The complaint, originally filed in the Law Division of the Circuit Court of Cook County on July 30, 2026, seeks to hold the responsible parties accountable for the injuries and damages allegedly suffered by the plaintiff.

The lawsuit alleges the plaintiff consumed a Wendy’s double cheeseburger and baked potato before subsequently developing symptoms consistent with a Campylobacter infection. The plaintiff later received medical attention and was diagnosed with Campylobacter, a bacterial infection that can cause significant gastrointestinal illness and other complications.

The lawsuit alleges that the food consumed by the plaintiff was contaminated and that the contamination resulted in the plaintiff becoming ill. The lawsuit alleges the plaintiff suffered from a Campylobacter infection, resulting in her being hospitalized twice. She incurred medical bills of approximately $94,857.24. John J. Malm & Associates is pursuing the case on behalf of the plaintiff and intends to seek appropriate compensation for the injuries, medical expenses, pain and suffering, and other damages alleged in the complaint.

Allegations Involving the Wendy’s Meal

The complaint filed on behalf of the plaintiff centers on food purchased from Wendy’s, including a double cheeseburger and baked potato. The plaintiff alleges that after consuming the meal, they developed significant illness and were subsequently diagnosed with Campylobacter infection.
