How We Win

Award-Winning Illinois Injury Trial Attorneys

John J. Malm

At John J. Malm & Associates, we have achieved a 99% success rate across the cases we handle, large and small. That record did not happen by accident. It reflects more than three decades of careful preparation, hard work, persistence, and a commitment to putting our clients first.

Winning a personal injury case is rarely about one dramatic moment. More often, it is the result of hundreds of decisions made correctly along the way: listening carefully to the client, investigating the facts, preserving evidence, understanding the medicine, anticipating defenses, preparing for trial, and refusing to settle a case for less than it is worth.

We are accomplished trial lawyers, but being prepared to try a case is only part of what sets our firm apart. We know what it takes to bring a personal injury case from the first client meeting through a successful resolution.

We Listen First

Every case begins with listening. Before we can effectively represent a client, we need to understand what happened and how the injury has affected that person’s life. That means understanding not only the accident itself, but the medical treatment, time away from work, physical limitations, pain, emotional impact, and the ways an injury has changed everyday life.

Clients often know details about their case that will never appear in a police report or medical record. We take the time to learn those details because they may ultimately become some of the strongest evidence in the case.

We Prepare Every Case for Trial

Insurance companies know which lawyers regularly prepare cases for trial and which lawyers are primarily looking for quick settlements. We prepare our cases with the expectation that we may ultimately have to prove them before a judge and jury. That approach influences everything we do, from the way evidence is collected to the questions we ask witnesses, the experts we retain, and the manner in which we document our client’s injuries.

Thorough trial preparation also makes us better negotiators. An insurance company is much more likely to make a serious settlement offer when it knows that the lawyers on the other side are ready and willing to try the case.

We Never Take the Easy Settlement

Our goal is not simply to settle cases. Our goal is to resolve each case for the best result reasonably available under its particular facts. There is often pressure in personal injury cases to accept an early offer. Sometimes an early settlement is appropriate. Often it is not.

We carefully evaluate the nature of the injury, medical treatment, permanent consequences, insurance coverage, liability evidence, lost income, and all other damages before recommending that a client accept a settlement. We will not recommend a settlement simply because it is convenient or because litigation may become difficult. We do what is best for you.

We Find the Strength in Every Case

Very few personal injury cases are perfect. There may be disputes over how an accident happened. A medical record may contain an unfavorable entry. A client may have a preexisting condition. A witness may remember events differently. The insurance company may attempt to blame the injured person or minimize the severity of the injury.

Our job is to identify the strongest parts of the case and use them effectively. Sometimes a powerful photograph tells the story. Sometimes it is a medical image, an independent witness, video footage, an expert opinion, or a defendant’s own testimony. In other cases, the most important evidence is simply the credibility of our client and the consistency of the facts.

Good lawyers recognize weaknesses. Successful trial lawyers also know how to put those weaknesses into perspective while building the case around the evidence that matters most.

We Do Not Give Up When a Case Gets Difficult

Serious personal injury cases often present unexpected challenges. Insurance companies deny claims. Defendants dispute responsibility. Important witnesses become difficult to locate. Experts disagree. Coverage issues arise. Cases that appear straightforward at the beginning can become complicated.

We do not abandon a good case simply because it becomes difficult. Our attorneys work through those problems, reconsider strategies when necessary, develop additional evidence, and continue moving the case forward. Persistence matters. Some of our most successful results have come in cases where significant obstacles had to be overcome before the insurance company finally recognized the true value of the claim.

We Keep Our Clients Informed

A client should never feel like a spectator in his or her own case. We believe communication is an important part of good representation. Our clients deserve to know what is happening, what comes next, and why important decisions are being made.

We explain the process, discuss significant developments, answer questions, and involve our clients when important choices need to be made. Ultimately, it is the client’s case. Our responsibility is to provide the information, experience, and advice necessary to help that client make informed decisions.

We Remember Who the Case Is About

Personal injury litigation can involve insurance adjusters, defense lawyers, doctors, experts, depositions, court appearances, medical records, and thousands of pages of documents. But behind every case is a person.

Our clients come to us because something important has happened in their lives. They may be injured, unable to work, worried about their future, or grieving the loss of someone they love. We never want the legal process to cause us to lose sight of that. At John J. Malm & Associates, the client comes first.

Reputation Matters When It Is Time to Negotiate

Over more than 33 years of practicing personal injury law, John J. Malm has learned that a lawyer’s reputation is built case by case. Insurance companies and defense lawyers pay attention to results. They know which firms thoroughly prepare their cases. They know which attorneys are willing to file lawsuits, take depositions, retain experts, and go to trial when necessary. That reputation creates leverage.

When the time comes to negotiate, the insurance company needs to know that rejecting a reasonable settlement demand may mean facing attorneys who are fully prepared to present the case to a jury. There is no shortcut to earning that credibility. It comes from years of preparation, successful results, and following through when difficult cases require litigation.

Our Approach to Winning

There is no formula that guarantees the outcome of any individual personal injury case. Every claim depends on its own facts, evidence, law, injuries, and available insurance coverage. But our approach has remained remarkably consistent:

We listen. We investigate. We prepare. We communicate. We find the strongest evidence. We confront weaknesses directly. We remain patient when patience is required, aggressive when circumstances demand it, and ready for trial when an insurance company refuses to be reasonable. Most importantly, we never forget who we represent. That is how we have built our reputation. And that is how we win.
